Terms & Conditions Things You Should Know!

The participant(s) acknowledge receiving and agreeing to these terms and conditions as set forth below covering the vacation to be operated by Olé Travel,San Francisco, CA.

RESERVATION/PAYMENT Call or visit your Travel Agent for reservations. A non-refundable deposit of $150 per person is due within 7 days of booking. (For bookings between Dec 17 & Jan 9 and for Easter week the deposit is required at booking.) Full payment is due 30 days prior to departure. (For itineraries with CRUISES the deposit is $350 per person, and final payment is due 60 days before departure.) Additional deposits may be necessary during high season in most countries-such deposits are non-refundable. Payment of a deposit constitutes acceptance of all these Terms and Conditions. If payment is made by credit card, participant(s) waive any chargeback rights.

RATES All rates quoted are based on tariffs at time of printing, and are subject to change. Prices are per person, based on 2 passengers traveling together at any time. Single rates still imply that 2 persons min. traveling; if a single person wants to travel with no other passengers, additional costs will be charged. Child rates are available for air and in most hotels but not in all. Reductions are based on a child sharing a room with at least 2 adults. If there is only 1 adult accompanying the child, adult pays single rate to receive special rate for child.

INCLUDED/NOT INCLUDED Everything specifically mentioned in the itinerary in hotels/lodges indicated. The right is reserved to substitute hotels. Not included are US departure Tax/Custom fees, airport/port taxes, gratuities and any item not specifically mentioned as included.

TOUR COST INCLUSIONS Olé negotiates for the best possible rate available at the time of booking considering quality, quantitiy and type of service offered. In our rates to you, we have to include general costs, all commissions and credit fees and Olé compensation for operation, supervision, promotion and profit. Once quotes are accepted, no adjustment for rates paid can be made.

DOCUMENTS/VOUCHERS Vouchers and tickets are issued after final payment is received. Final documents CANNOT be issued if a copy of this page is not received duly signed by the passenger.

CANCELLATIONS/REFUNDS Your right to refunds if you change or cancel your reservation is limited. The following per person fees apply:

These cancellation fees are applied above any air ticket cost. Cancellations must be in writing. Olé reserves the right to cancel any booking, or part of it, at any time as a result of force majeure or for reasons outside Olé's control. No refunds will be made for unused travel services, nor is the price or value of unused travel services exchangeable for alternative arrangements.

LATE BOOKINGS/CHANGES Late bookings (within 15 days) are accepted on space available basis; a late booking fee of $30 is required and overnight express cost will be added. All bookings requested within 30 days of departure MUST be guaranteed by credit card. There is a $30 fee for each change made after confirmation. Within 30 days of travel any changes in dates will be treated as a cancellation and penalties will apply. Names changes are subject to hotel acceptance and penalties. Additional change charges will apply for resrvations involving scheduled air service.

INSURANCE Due to strict enforcement of cancellation penalties by suppliers, cancellation insurance is VERY STRONGLY RECOMMENDED.

CREDIT CARD PAYMENTS: We accept VISA, MASTERCARD, DINERS & AMERICAN EXPRESS.Verbal authorization binds clients to all terms and conditions and allows us to process reservation at quoted cost. With the reception of documents, card holders acknowledge receipt of services and agree to perform the obligations set forth in the agreement with the card issuer.

ALL SERVICES ARE PREPAID. NO REFUNDS POSSIBLE ON SERVICES
FULLY OR PARTIALLY NOT USED.

DOCUMENTATION U.S. citizens need to have a valid passport (visa is necessary for some countries). It is your responsibility to obtain information and proper documentation-(ask your Travel Agent). Olé assumes no responsibility for changes in document requirements nor for entry into any destination for any passenger not having proper documentation. Passengers denied boarding because of improper documentation will receive no refund. Full cancellation penalties apply to cancellations due to incorrect documentation.
AIR TRANSPORTATON Once tickets are issued they are non-refundable and non-endorsable. Penalties apply for name and date changes and arethe responsibility of the passenger. Air carriers will change a reservation if space is available in the proper class of service for an additional fee to be paid by the passenger.
BAGGAGE Internationally checked luggage is limited to a maximum weight not to exceed 44 pounds and 30" x 17" x 10" in dimension. Flights operated within a foreign country are usually on smaller aircraft, with luggage limited to 25 lbs. Olé is not responsible for any baggage charge for excess weight or for any luggage having to be left behind for not complying with these regulations.
CRUISE ITINERARIES Itineraries on smaller cruise ships may be subject to changes due to many conditions/ reasons. No refunds can be requested for any alteration of itinerary, even if the cruise does not touch the originally planned ports of call. GALAPAGOS PARK TAX is NOT included in rate and must be paid locally by each passenger. GRATUITIES to crew/guides are not included.
PHYSICAL LIMITATIONS Passengers able to walk a few hours a day, unassisted, will enjoy most itineraries. Some excursions are strenuous, involving long walks. On many itineraries in Latin America, road conditions can be difficult and a ride may take a full day to cover a short distance. Most ecotourism programs are not recommended if you are not fullly mobile. Handicapped, we regret, cannot participate as there are no facilities to accomodate them.
SCHEDULE & DELAYS All travel times are based on the best information and timetables available at confirmation. Because of the nature of the destination, changes to schedule and/or itinerary may be necessary and may prevent the inclusion of some activities scheduled for the day. No refunds can be given for such eliminations. We also cannot accept any responsibility for losses or accidental expenses due to changes or delays in airline schedules, hotel overbookings or defaults, weather, strikes, sickness, war, riots or any other causes. All such losses/expenses are the responsibility of the passenger.
RESPONSIBILITY Olé has made arrangements for the tour services described in this brochure/invoice through independent contractors which are not the agents or employees of Olé or its affiliates. All travel vouchers and other travel documents issued by Olé are subject to the terms and conditions of the supplier;to the laws of their countries and to international conventions between countries. Any complaint should be sent in writing within twenty (20) days of return. Olé reserves the right to accept or reject any person as a tour participant, to make changes in the itinerary whenever deemed necessary for the convenience or safety of the participant and to cancel a tour at any time. If a tour is canceled, Olé shall have no liability beyond the refund of all monies paid by the passenger which will be deemed to constitute full and final settlement. If the services included cannot be supplied or there are changes in the program, Olé will use its best efforts to arrange for comparable services where applicable. Any resulting additional expenses will be the responsibility of the participant. The participant agrees that neither Olé nor its affiliates and employees shall be liable for any damages, loss (including but not limited to personal injury, mental distress, loss of employment, death and property loss) inconvenience, or expense occasioned by any act or omission of any supplier providing tour services, or by any change in itinerary unless caused by the negligence of Olé or its employees in its contractual duty. The tour participant expressly waives all rights which he or she may have against Olé in connection with the foregoing. No person, other than an officer of Olé by a document in writing, is authorized to vary or waive any condition in this brochure. Under no circumstances is Olé to be constructed as a carrier under contract for safe carriage of the passenger or his/her luggage and belongings. No carrier shall have any responsibility except its liability as a common carrier. By enrolling in and paying for a tour, participants agree to accept and are bound by the terms and conditions in this brochure.
